Will of Thomas Ming (5)

 In the name of God amen, I Thomas Ming of Chowan County and State of North Carolina being of sound mind memory and understanding do make and ordain this my last will & testament in manner and form following: lst the Manner Plantation that I obtained by the gift of my Father and death of my brother Joseph Ming I give and bequeath unto my two sons Joseph Ming and James Ming containing by survey six hundred and sixty two acres to be equally divided between my two said sons and the heirs of their bodies lawfully begotten forever --- Item I give and bequeath unto my daughter Rachel Gregory a certain part of land I purchased of John Ming beginning at a gum and running up the Meeting House Branch and thence including the Ridge Land by Creecy's line to the said gum to her and the heirs of her body lawfully begotten forever.  Item I give unto my daughter Penelope Ming the remainder part of the said land that I purchased of John Minge reserving my beloved wife Delilah Ming the use and occupation of said Penelopes land during her natrel life.  Item I give unto my beloved son Wiley Ming the Plantation where on I now live --- formerly the property of Thomas Coffield sold by act of Assembly agreeable to Law to him my said son Wiley Ming and the heirs of his body lawfully begotten forever.  Item I give and bequeath unto Barthelewmew Warbutton son of Mary Warbutton the use of the Thick Neck Plantation containing by estimation two hundred acres be the same more or less for and during his natural life and to the heirs of his body lawfully begotten forever but in case the said Barthelewmew Warbutton should die without such lawful heirs then the said land to be equally divided between my five children Joseph Ming, James Ming, Rachel Gregory, Wiley Ming and Penelope Ming.  I also give unto the said Barthelemew Warbutton a cow and calf to be placed on the ' said Plantation after my decease.  Item I give unto Mary Babcock an orphan child that was brought up in my house a cow and calf on the day of her marrage Item I give unto my beloved wife Delilah Ming the use of two Negro slaves known by the name of Ben and Poll for and during her natural life.  Item my will is that all the remainder part ofmy Negro slaves shall be equally divided between my five above mentioned children Joseph, James, Rachel, Wiley and Penelope.  Item I give unto my beloved wife Delilah Ming my son Wiley Ming and my daughter Penelope Ming all my stock of horses hogs and cattle that are now in my possession with all and every other article out dores and in dores not before mentioned to be equally divided between my said wife son and daughter.  Item it is my will and desire that my lawful debts should be discharged after my decease by the sale of my barrels hogsheads and salt and fishing utensils after which the ballance if any to be equally divided between my said wife my son Wiley and my daughter Penelope --- and whereas I have several notes and open accounts ag @ t several people to a considerable amount with said notes and open accounts it is my will and earnest desire that the amount when recovered should be equally divided between my said wife my son Wiley and my daughter Penelope and all share and share alike after committing my body to the Earth from whence it came and my Soul to God who gave it.  It is my will and desire that the worshipful court of Chowan should appoint guardians to this my last will as they in there wisdom think fit to see and bring up my two youngest children and orphans.  In witness whereof I have hereunto set my hand and Seal this sixth day of November 1796 signed seald and delivered according to Law and in presence of us
